By signing up and actively using the pumpkin-mails.com program you agree to all terms and conditions set forth in this agreement. pumpkin-mails.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the pumpkin-mails.com program following a change in policy or new agreement on our site will constitute binding acceptance to the change.

Pumpkin-Mails has the right, in its sole discretion, to suspend or cancel, at any time and for any reason, a members membership in and access to Pumpkin-Mails website and Pumpkin-Mails sevices. All Earnings may be cancelled in Pumpkin-Mails sole discretion.

Responsibility of Members:
You must be 18 years of age or older to participate in this program. Our program is open to both US and International affiliates and is void where prohibited by local governing laws.

You agree to and must use your own name and e-mail address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different e-mail addresses. Your computer must not be shared with another individual that has an existing pumpkin-mails.com account.

You will use your e-mail address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.
You are solely responsible for any and all use of your pumpkin-mails.com account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by pumpkin-mails.com be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you used when signing up pumpkin-mails.com . You must maintain your e-mail account that you used when signing up with pumpkin-mails.com . You agree to receive e-mail advertising from pumpkin-mails.com, limited to no more than (50) per day.

In the event your e-mail account on file becomes closed or blocked to messages from pumpkin-mails.com, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately.

The money you pay to upgrade your Pumpkin-Mails account is a membership fee, not an investment or deposit. Money paid to you by Pumpkin-Mails is earned by you for your use of the services and is not interest.

You understand that Pumpkin-Mails has no guarantee of earnings or profits, that you may not earn your money back or make any profit.

Any member who requests Upgrades & Advertising without paying for them or requesting Platinum Member Payout if they are not Platinum Members will have their account fined.

Any member that continuously requests Upgrades & Advertising without paying for them, clicks too many cheat links or has too many bad turning number clicks will have their account suspended.

Any member that signs up for multiple accounts, has too many cheat links, inactive for 30 days or selects the keyword Delete Me as one of their categories of interests will have their account deleted.

Any member that selects the keyword Donate My Earnings as one of their categories of interest will have their earnings donated.

Any member that is not upgraded that requests an upgraded member payout will not be refunded their earnings as it will be considered a donation.

Relationship of the Parties:
You and pumpkin-mails.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and pumpkin-mails.com . You understand that you do not have authority to make or accept any offers or make any representations on behalf of pumpkin-mails.com. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:
pumpkin-mails.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or pumpkin-mails.com program, even if pumpkin-mails.com has been advised of the possibility of such damages. Furthermore, pumpkin-mails.com aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.

Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Pumpkin-Mails. Members may earn by referring new members to Pumpkin-Mails. Members will earn a percentage of advertising revenues collected by Pumpkin-Mails. Members will be paid via Paypal, Liberty Reserve, Alertpay & Moneybookers. Pumpkin-Mails will pay members when their balance reaches the minimum payout rate set by Pumpkin-Mails. Once the member has reached $10,000 they may request payment. All payments for the current month will be done within 30 days of the following month. Payment value will depend on the site revenue. 50% of site income goes to members and is divided between all payment requests received during the given month. Upgraded members will recieve higher payments than free members.

Pumpkin-Mails will not pay members if they violate any of the following:
-Delete me or donate my earnings as one of their keywords for categories of interest.
-Clicking emails with cheat links in them.
-Requesting upgrades and advertising without paying for them.
-Too many bad turning number clicks.
-Sending us threatening or harassing emails.
-Inactive for 30 days.
-Signing up with more than one account from the same computer.

Pumpkin-Mails reserves the right to deny any payment request at our sole discretion. Pumpkin-Mails reserves the right to deny anyone the All Access Visa Debit Card at our sole discretion. The images displayed on the payments made page are to encourage members in the program to help bring in more advertising revenue. The images shown are an example of potential real payments that could be made depending on advertising revenue.

Cheat Links:
We send out cheat links weekly and members that click it will lose a certain amount of their earnings each time they click it.

Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with pumpkin-mails.com and may result in legal prosecution. pumpkin-mails.com strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. pumpkin-mails.com may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. pumpkin-mails.com will file charges for recovery of any earnings received from multiple sign-ups.

You agree that use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis, to the maximum extent allowed by applicable law. Pumpkin-Mails expressly disclaims all warranties of any kind, express or implied by law, custom or otherwise, including without limitation any warranty of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement. Pumpkin-Mails makes no warranty regarding any goods or services purchased or obtained through the program or any transactions entered into through the program. Pumpkin-Mails reserves the right to deny any purchases at our sole discretion without offering a refund.
